§ 74-33. Authority of the board of county commissioners.

  • The board of county commissioners has the authority to:

    (1)

    Prescribe and enforce regulations for the protection of the health, safety and welfare of the citizens of the county.

    (2)

    Prescribe, after a public hearing, and adopt by resolution, a schedule of rates, fees and charges for solid waste disposal.

    (3)

    Prescribe, after a public hearing, rules and regulations reasonably necessary and proper for the administration and enforcement of this article.

    (4)

    At its discretion provide for the disposal of solid waste and is authorized and empowered to dispose of solid waste using, among other methods the following:

    a.

    Incinerators constructed and operated by the board.

    b.

    Incinerators constructed and operated by a private industry under contract with the board.

    c.

    Incinerators constructed and operated by municipal corporations or contiguous counties.

    d.

    Composting plants, whether privately or government owned and operated.

    e.

    Sanitary landfills, whether privately or government owned and operated.

    f.

    Treatment plants with the manufacturer of a by-product of solid waste and refuse, such as methane gas.

    g.

    Resource recovery system processing to recover reusable products such as aluminum cans.
