§ 74-31. Definitions.

  • The following words, terms and phrases when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Coordinator means the individual designated by the board of county commissioners or his duly authorized representative.

    Delinquent accounts means those payment accounts established which have fallen past due paying monthly charges for use of a disposal facility.

    Garbage means all waste and accumulation of animal, fruit or vegetable matter that attends, or results from the preparation, use, handling, cooking, serving or storage of meats, fish, fowl, fruit, vegetable matter of any nature whatsoever, which is subject to decay, putrefaction and the generation of noxious and offensive gases or odors, or which may serve as breeding or feeding material for flies and/or other germ carrying insects. It shall also mean all accumulation of leaves, grass or shrubbery, cuttings and other refuse attending the care of lawns, shrubbery, vines, trees and tree limbs. Such term does not include large quantities of sod, dirt or other materials requiring special handling. The word garbage shall also include refuse, accumulation of paper, rags, wooden or paper boxes or containers.

    Hazardous waste means solid waste, or a combination of solid wastes, which, because of its quantity, concentration, or physical, chemical, or infectious characteristics, may cause, or significantly contribute to, an increase in mortality or an increase in serious irreversible or incapacitating reversible illness or may pose a substantial present or potential hazard to human health or the environment when improperly transported, disposed of, stored, treated, or otherwise managed. The term does not include human remains that are disposed of by persons licensed under F.S. ch. 470.

    Payment accounts means accounts established by users of the county's solid waste disposal facility so that they may use such facility and pay in accordance with the provisions of this article.

    Sanitary landfill means the place specifically set aside by the county for disposal of solid waste.

    Schedule of rates, fees and charges means the published resolution approved by the board of rates, fees and charges to be assessed the customer for services rendered by the county.

    Security deposit account means cash, escrow agreement, a surety bond or a letter of credit deposited with the county clerk of circuit court pursuant to establishing payment accounts.

    Special waste means solid waste that can require special handling and management, including, but not limited to, white goods, waste tires, used oil, lead-acid batteries, construction and demolition debris, ash residue, yard trash, and biological wastes.
