§ 58-242. Penalties.

  • (a)

    The county may pursue any enforcement action or legal remedy available under controlling State law and any legal remedy available to the county to include, but not be limited to, prosecution as a misdemeanor with a fine not exceeding $500.00, or by imprisonment for a term not exceeding 60 days, or by both fine and imprisonment.

    (b)

    Each day of continued violation or noncompliance shall constitute a separate offense.

    (c)

    Nothing herein contained shall prevent the county from taking such other lawful action in law and equity as may be necessary to remedy any violation or refusal to comply with this article or the safeguards which may be effectuated pursuant to the ordinance, including but not limited to:

    (1)

    Injunctive and/or declaratory relief in a court of competent jurisdiction.

    (2)

    Any action to recover any and all damages that may result from a violation of this article.

    (3)

    Any other action or enforcement method allowable by law.
