§ 50-765. Essential public utility services.

  • The following provisions apply to essential public utility services:

    (1)

    Where located within 200 feet of any residential district or any existing residence, a visual screen ten feet high, or a vegetative evergreen buffer which will be at least ten feet in height at maturity, shall be provided on the side of any structure other than a utility pole.

    (2)

    Where located within 100 feet of any highway right-of-way, screening as provided in subsection (1) of this section shall be provided along the front lot line.

    (3)

    Wherever possible, public utilities shall be routed or located so as to avoid existing populated areas. Where such avoidance is impossible, the utilities should be located and designed to minimize adverse aesthetic impacts.

    (4)

    Regardless of size, all proposed developments shall ensure the availability of suitable land for utility facilities necessary to support the proposed development.
