§ 47-69. Imposition of road impact fee.

(a)

The board hereby adopts the following schedule of road impact fees, which are imposed upon all road impact construction occurring within all unincorporated areas of the county at a rate established under the applicable road impact fee land use category.

(b)

The board hereby establishes four road construction districts, as shown in appendix D* attached to Ordinance Number 2005-08, for purposes of collection and expenditure of the road impact fees.

(1)

As shown in appendix D* (attached to Ordinance Number 2005-08), Road Construction District No. 1 is established for the area of the county lying west/northwest of SR 24 and east/northeast of US 19. All road impact fees collected from road impact construction occurring within Road Construction District No. 1 shall be expended to construct or improve the county road system within this district, including collector roads and local roads, or expended to construct or improve an arterial road providing a countywide benefit.

(2)

As shown in appendix D* (attached to Ordinance Number 2005-08), Road Construction District No. 2 is established for the area of the county lying east/southeast of SR 24 and east/northeast of US 19. All road impact fees collected from road impact construction occurring within Road Construction District No. 2 shall be expended to construct or improve the county road system within this district, including collector roads and local roads, or expended to construct or improve an arterial road providing a countywide benefit.

(3)

As shown in appendix D* (attached to Ordinance Number 2005-08), Road Construction District No. 3 is established for the area of the county lying west/southwest of US 19 and southeast of SR 24. All road impact fees collected from road impact construction occurring within Road Construction District No. 3 shall be expended to construct or improve the county road system within this district, including collector roads and local roads, or expended to construct or improve an arterial road providing a countywide benefit.

As shown in appendix D* (attached to Ordinance Number 2005-08), Road Construction District No. 4 is established for the area of the county lying west/southwest of US 19 and northwest of SR 24. All road impact fees collected from road impact construction occurring within Road Construction District No. 4 shall be expended to construct or improve the county road system within this district, including collector roads and local roads, or expended to construct or improve an arterial road providing a countywide benefit.

(c)

Except as otherwise provided in this chapter, the road impact fee shall be paid directly to the county or municipality prior to the issuance of a building permit.
