Article I. YEAR-ROUND WATER CONSERVATION AND WATER SHORTAGE REGULATIONS |
§ 34-7. Declaration of water shortage; water shortage emergency.
(a)
Upon declaration of a water shortage or water shortage emergency within all or any part of Levy County by the governing board or the executive director of either or both districts, all water shortage restrictions adopted by the Suwannee River Water Management District applicable to the unincorporated area of the county, or any portion thereof, shall be subject to enforcement action pursuant to this article and any other enforcement methods allowed under this Code or by other law throughout the entire unincorporated area of the county. Any violation of the provisions of chapter 40B-21, Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this article.
(b)
Notwithstanding the provisions of subsection (a) of this section, in the event that the provisions of the Suwannee River Water Management District water shortage restrictions are less restrictive than that district's year-round water conservation measures, the more restrictive year-round water conservation measures shall continue to apply. Any violation of such more restrictive year-round water conservation measures contained in chapter 40B-2.041(9)(d), Florida Administrative Code, shall be a violation of this article.
(c)
Water shortage restrictions adopted by the Southwest Florida Water Management District in chapter 40D-21, Florida Administrative Code, shall not apply within the boundaries of the County, provided that the water shortage restrictions of the Suwannee River Water Management District are in effect, and provided further that any interagency agreement between the two districts governing the applicability of Suwannee River Water Management District water shortage restrictions throughout the county remains in effect.
(d)
In the event that either the water shortage restrictions adopted by the Suwannee River Water Management District or any interagency agreement between the districts as provided in section 34-7 (c) do not remain in effect, then all water shortage restrictions adopted by the Southwest Florida Water Management District in chapter 40D-21, Florida Administrative Code, as the same may be amended from time to time, shall be applicable to the unincorporated areas of the county located within the boundaries the Southwest Florida Water Management District, or any portion thereof, shall be subject to enforcement action pursuant to this article and any other enforcement methods allowed under this Code or by other law throughout the entire unincorporated area of the county. Any violation of applicable provisions of chapter 40D-21, Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this article.
