§ 34-5. Applicability of year-round water conservation measures.

  • (a)

    All lawn irrigation, landscape irrigation and related outdoor year-round water conservation measures adopted by the Suwannee River Water Management District in section 40B-2.041(9)(d), Florida Administrative Code, as the same may be amended from time to time, shall be applicable to the unincorporated areas of the county located within the boundaries of either District, except as otherwise provided herein, and shall be subject to enforcement action pursuant to this article and any other enforcement methods allowed under this Code or by other law. Any violation of the provisions of section 40B-2.041(9)(d), Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this article.

    (b)

    Year-round water conservation measures adopted by the Southwest Florida Water Management District in chapter 40D-22, Florida Administrative Code, shall not apply within the boundaries of the County, provided that the year-round water conservation measures of the Suwannee River Water Management District are in effect, and provided further that any interagency agreement between the two districts governing the applicability of Suwannee River Water Management District year-round conservation measures throughout the county remains in effect.

    (c)

    In the event that either the year-round water conservation measures adopted by the Suwannee River Water Management District or any interagency agreement between the districts as provided in section 34-5 (b) do not remain in effect, then all lawn irrigation, landscape irrigation and related outdoor year-round water conservation measures adopted by the Southwest Florida Water Management District in chapter 40D-22, Florida Administrative Code, as the same may be amended from time to time, shall be applicable to the unincorporated areas of the county located within the boundaries the Southwest Florida Water Management District, and shall be subject to enforcement action pursuant to this article and any other enforcement methods allowed under this Code or by other law. Any violation of applicable provisions of chapter 40D-22, Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this article.
