§ 26-33. Assessment of additional court costs.

  • (a)

    Imposition of court costs. There is hereby imposed, pursuant to F.S. § 939.185, an additional court cost of $65.00 upon each person who pleads guilty or nolo contendere to, or is found guilty of, any felony, misdemeanor, or criminal traffic offense under the laws of the State of Florida.

    (1)

    The court shall order a person to pay the additional court cost.

    (2)

    If a person is determined to be indigent, the clerk shall defer payment of this cost pursuant to F.S. § 28.246.

    (b)

    Accounting for and allocation of revenues. The additional court cost imposed pursuant to subsection (a), above, shall be accounted for separately and shall be allocated as follows:

    (1)

    Twenty-five percent of the amount collected shall be allocated to the innovations to supplement state funding for the elements of the state court fund system in Levy County identified in F.S. §§ 29.004 and 29.008(2)(a)2;

    (2)

    Twenty-five percent of the amount collected shall be allocated to assist in providing legal aid programs under F.S. § 29.008(3)(a);

    (3)

    Twenty-five percent of the amount collected shall be allocated to fund personnel and legal materials for the public as part of a law library; and

    (4)

    Twenty-five percent of the amount collected shall be used as determined by the board to support teen court programs, juvenile assessment centers, and other juvenile alternative programs.
