§ 22-102. Applicability of ordinance.

  • (a)

    All existing sexually oriented businesses and sexually oriented business employees are hereby granted a de facto temporary license to continue operation or employment for a period of 90 days following the effective date of this article. By the end of said 90 days, all sexually oriented businesses and sexually oriented business employees must conform to and abide by the requirements of this article.

    (b)

    This article shall apply throughout the unincorporated area of the county and in any incorporated area of any municipality whose governing body has, by ordinance, consented to the applicability within its jurisdictional boundaries, and who has provided written notice to the county of its intent to adopt such ordinance at least ten days prior to date of such adoption. Nothing contained in this section shall prohibit any municipality from adopting an ordinance establishing licensing requirements or otherwise regulating sexually oriented businesses within the boundaries of such municipality to be administered by the municipality independently of the county.
